Terms of Service

These Terms of Service ("Terms") govern your access to and use of Aigenta products, services, and website. By signing up for an Aigenta account or using our services, you agree to these Terms. If you do not agree, do not use Aigenta.
Aigenta is a DBA of Third Wave Technology. "Aigenta," "we," "us," and "our" refer to Aigenta / Third Wave Technology throughout these Terms.
1. Eligibility
You must be at least 18 years old and have the legal authority to enter into a binding agreement to use Aigenta. If you are using Aigenta on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. Description of Services
Aigenta provides AI-powered business communication tools, including:
- Call Agent: An AI-powered voice agent that answers inbound calls, captures leads, books appointments, and routes inquiries for your business
- Web Contact Agent: An AI-powered chat agent that replaces static contact forms, qualifies leads, and filters spam from your website
Services are delivered as software-as-a-service (SaaS) subscriptions and are subject to the features and limitations of your selected plan.
3. Account Registration
To use Aigenta, you must create an account and provide accurate, complete information. You are responsible for:
- Keeping your account credentials secure
- All activity that occurs under your account
- Notifying us promptly of any unauthorized access or security breach
Aigenta reserves the right to suspend or terminate accounts that violate these Terms.
4. Free Trial
Aigenta offers a 30-day free trial for eligible subscription plans. The following terms apply to the free trial:
- A valid credit card is required to start your trial
- You will not be charged during the 30-day trial period
- At the end of the trial, your subscription automatically converts to a paid plan and your payment method is charged
- To avoid being charged, you must cancel your subscription before the trial period ends
- Aigenta reserves the right to modify or discontinue free trial offers at any time
5. Subscription and Billing
Aigenta subscription plans are billed on a monthly basis. By subscribing, you authorize Aigenta to charge your payment method at the applicable rate at the start of each billing period.
- Subscription fees are charged in advance for the upcoming billing period
- If a payment fails, we will notify you and may suspend access to your account until payment is resolved
- Aigenta reserves the right to change subscription pricing with at least 30 days' notice to existing customers
- Founding Member pricing is locked for the lifetime of an active Founding Member subscription
6. Cancellation
You may cancel your subscription at any time through your Aigenta customer portal. Cancellation takes effect at the end of your current billing cycle. You will retain access to Aigenta services through the end of the period you have paid for.
Aigenta may suspend or terminate your account if you violate these Terms, your payment fails and is not resolved, or as required by law.
7. Refunds
Subscription fees paid after the free trial are generally non-refundable. Full details are in our Refund Policy.
8. Acceptable Use
You agree to use Aigenta only for lawful purposes and in accordance with our Acceptable Use Policy. You may not use Aigenta to send spam, harass individuals, violate privacy laws, or engage in any activity that harms others or violates applicable law.
9. Your Content and Data
You retain ownership of your business data, customer data, and content. By using Aigenta, you grant us a limited license to process and store this data as necessary to provide our services.
You are responsible for ensuring you have the right to collect and use the data your agent handles and that doing so complies with applicable privacy and communications laws.
10. Intellectual Property
Aigenta and its licensors own all rights to the platform, software, AI models, and other technology that make up the Aigenta service. Nothing in these Terms grants you ownership of Aigenta's intellectual property. You receive a limited, non-exclusive, non-transferable license to use Aigenta services as described in these Terms.
11. AI Disclosure
Aigenta's products are powered by artificial intelligence. You acknowledge that AI agents may occasionally produce incomplete or imperfect responses, and you agree to review all AI-generated outputs before acting on them. See our AI Transparency Policy for full details.
12. Disclaimers
Aigenta services are provided "as is" and "as available." We make no warranty that the services will be uninterrupted, error-free, or meet your specific requirements. To the fullest extent permitted by law, Aigenta disclaims all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Aigenta shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of or inability to use Aigenta services. In no event shall Aigenta's total liability to you exceed the amount you paid for Aigenta services in the 12 months preceding the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless Aigenta and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of Aigenta, your violation of these Terms, or your violation of any third-party rights.
15. Changes to These Terms
Aigenta may update these Terms from time to time. We will notify you of material changes by email or through your customer portal at least 14 days before the changes take effect. Continued use of Aigenta after changes take effect constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by the laws of the United States applicable to agreements entered into and performed therein. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
